1. Definitions

"Company", "We", "Us", or "Our" refers to Winger Kicks, a sportswear ecommerce business operating from Dhaka, Bangladesh. "Customer", "You", or "Your" refers to any individual or entity accessing the Site or placing an order. "Products" refers to all items available for purchase on the Site. "Order" refers to a confirmed purchase request submitted through the Site.

2. Eligibility

You must be at least 18 years of age to make a purchase. By placing an order, you represent and warrant that you are of legal age and have the legal capacity to enter into a binding agreement.

• Minors may browse the Site but must have a parent or guardian complete any purchase on their behalf.
• We reserve the right to refuse service to anyone for any reason at any time.

3. Product Authenticity & Descriptions

All products sold on Winger Kicks are 100% authentic. We source exclusively from authorized distributors and verified suppliers. However, Winger Kicks is an independent curated reseller and is not an official retail partner of any sports brand (Nike, Adidas, Puma, etc.).

• Product images are for illustrative purposes. Actual colors may vary slightly due to screen settings and lighting conditions during photography.
• We make every effort to ensure product descriptions, specifications, and sizing information are accurate, but errors may occasionally occur.
• We reserve the right to correct any errors in product listings, pricing, or descriptions at any time without prior notice.

4. Pricing & Payment

All prices are listed in Bangladeshi Taka (BDT / ৳) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice; however, any confirmed order will be honored at the price displayed at the time of purchase.

• We accept Cash on Delivery (COD) and bKash mobile payment.
• For COD orders, the full amount is payable upon delivery. Refusal to accept delivery may result in blacklisting from future COD orders.
• Promotional discount codes are single-use, non-transferable, and cannot be combined with other offers unless explicitly stated.
• We reserve the right to cancel orders where pricing errors are identified before dispatch.

5. Orders & Fulfillment

Placing an order on the Site constitutes an offer to purchase. All orders are subject to acceptance and availability. We reserve the right to decline or cancel any order at our sole discretion.

• Order confirmation does not guarantee dispatch. In rare cases, orders may be cancelled due to stock discrepancies, suspected fraud, or pricing errors.
• You may cancel your order within 2 hours of placing it by contacting us via WhatsApp. After this window, the order enters processing and cannot be cancelled.
• Estimated delivery times are indicative and not guaranteed. Delays caused by courier services, weather, or other circumstances beyond our control do not entitle the customer to a refund.

6. Shipping & Delivery

We currently ship to addresses within Bangladesh only. International shipping is not available at this time.

• Inside Dhaka: 2–3 business days. Outside Dhaka: 3–5 business days.
• Free shipping on all orders over ৳1,000. Standard shipping fee of ৳80 applies to orders under ৳1,000.
• Risk of loss and title for products pass to you upon delivery to the carrier.
• You are responsible for providing a correct and complete delivery address. We are not liable for delays or losses due to incorrect address information.

7. Returns & Refunds

We accept returns within 3 calendar days of delivery, subject to the following conditions:

• The item must be unused, unworn, unwashed, and in its original packaging with all tags attached.
• Returns initiated due to change of mind are subject to a restocking fee of ৳200. The return shipping cost is borne by the customer.
• Items received in defective or damaged condition, or incorrect items, qualify for a full refund including return shipping — provided photographic evidence is submitted within 24 hours of delivery.
• Refunds are processed within 5–7 business days via bKash to the customer's registered number.
• We reserve the right to refuse a return if the item shows signs of use, alteration, or damage not caused during shipping.

8. Exchanges

We offer one free size exchange per order within 3 calendar days of delivery.

• The item must be in unworn, original condition with all tags attached.
• Exchange is subject to stock availability of the requested size.
• If the requested size is unavailable, you may select a different product of equal value or receive a full refund.
• Only one exchange per order is permitted free of charge. Subsequent exchanges will incur shipping costs.

9. Non-Returnable Items

The following items are final sale and cannot be returned or exchanged:

• Customized or name-printed jerseys and products
• Items purchased during flash sales, clearance events, or with discount codes exceeding 20% off
• Items showing any signs of wear, washing, alteration, or damage by the customer
• Gift cards and digital products

10. Intellectual Property

All content on this Site — including but not limited to text, images, graphics, logos, product photography, UI design, and code — is the property of Winger Kicks or its licensors and is protected by applicable intellectual property laws.

• You may not reproduce, distribute, modify, or create derivative works from any content on this Site without prior written permission.
• All third-party trademarks, brand names, and logos displayed on this Site are the property of their respective owners and are used for product identification purposes only.

11. Limitation of Liability

To the maximum extent permitted by law, Winger Kicks shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products.

• Our total liability for any claim arising from an order shall not exceed the amount paid for the specific product(s) in question.
• We are not responsible for delays, losses, or damages caused by third-party courier services.
• We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Indemnification

You agree to indemnify, defend, and hold harmless Winger Kicks, its owners, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Site, violation of these Terms, or infringement of any third-party rights.

13. Privacy

Your use of the Site is also governed by our Privacy Policy. By using this Site, you consent to the collection and use of your data as described therein. Please review our Privacy Policy for full details.

14. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to this page. Your continued use of the Site after changes constitutes acceptance of the revised Terms. The "Last Updated" date at the top of this page indicates when these Terms were last revised.

15. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

• Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation.
• Any claim must be filed within one (1) year of the date the cause of action arose.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
